TALKHUB™ TERMS OF USE

Effective Date: February 2026

By accessing or using TalkHub™, including booking or participating in any session, you agree to the following Terms of Use.
If you do not agree, do not use this platform.

1. Service Classification

TalkHub™ provides non-clinical, time-based conversational access only.

Sessions are structured opportunities for individuals to speak and be heard by trained independent lay listeners™ in a neutral, non-directive environment.

TalkHub™ does not provide:

• Therapy
• Counseling
• Mental health treatment
• Diagnosis
• Treatment
• Coaching
• Crisis intervention
• Emergency services
• Medical advice
• Legal advice
• Financial advice
• Professional advice
• Any service requiring state or international licensure

TalkHub™ is not a substitute for licensed care of any kind.

Sessions are time-based conversations. Payment is for time and access — not outcomes.

2. Age Eligibility

TalkHub™ services are available only to individuals 18 years of age or older.

By booking a session, you affirm that you are at least 18 years old.

TalkHub™ relies on user attestation during soft launch and does not independently verify age or identity.

3. Personal Responsibility

You acknowledge and agree:

• You are solely responsible for your decisions, actions, and interpretations.
• TalkHub™ does not provide instruction, direction, or advice.
• Participation is voluntary and at your own discretion.

You understand that conversation alone does not constitute professional care.

4. Respectful Conduct Requirement

TalkHub™ maintains a neutral, respectful conversational environment.

The following are strictly prohibited:

• Explicit sexual content
• Lewd or suggestive conduct
• Hate speech
• Harassment
• Threats
• Abusive or violent language
• Illegal activity discussion
• Attempts to manipulate or intimidate listeners

If inappropriate conduct occurs:

• The session may be terminated immediately at listener discretion.
• No refund will be issued.
• Future access may be restricted or permanently denied.

Termination decisions are final.

5. Crisis & Safety Boundaries

TalkHub™ is not a crisis service.

If conversation content involves:

• Active self-harm ideation
• Threats of violence
• Immediate danger
• Emergency-level distress

The session may be ended and you may be directed to appropriate external resources.

TalkHub™ does not provide crisis intervention.

If you are experiencing an emergency, contact local emergency services immediately.

6. Booking & Payment Policy

• Payment is required prior to session confirmation.
• All purchases are final.
• One reschedule is permitted with at least 24 hours’ notice.
• Missed sessions are non-refundable.
• Late arrivals beyond 5 minutes may result in cancellation at listener discretion.

Refunds are not issued for dissatisfaction with subjective conversational experience.

7. Confidentiality & Recording Policy

TalkHub™ does not record sessions.

No session transcripts or archives are maintained.

Minimal internal operational logs may be kept for scheduling, compliance, or safety purposes only.

Users agree not to record sessions without express written permission.

8. Privacy & Data Processing

TalkHub™ collects only necessary information:

• First name
• Email address
• Payment information (processed securely via third-party providers)

Payment data is processed through Stripe or other secure payment processors and is not stored directly by TalkHub™.

Personal information is processed in accordance with applicable data protection laws.

By using the platform, you consent to the processing of your data in the United States.

TalkHub™ does not sell personal data.

9. Geographic Scope

TalkHub™ operates from the United States.

TalkHub™ makes no representation that the platform is appropriate or available in all jurisdictions. Users access the platform at their own initiative and are responsible for compliance with local laws.

10. Limitation of Liability

TalkHub™ provides access to conversation only.

To the fullest extent permitted by law:

TalkHub™ disclaims liability for decisions, actions, emotional responses, or outcomes resulting from participation.

Under no circumstances shall TalkHub™ be liable for indirect, incidental, consequential, or punitive damages.

Total liability, if any, shall not exceed the amount paid for the session in question.

11. Intellectual Property

All TalkHub™ branding, language, frameworks, and proprietary materials are protected intellectual property.

Unauthorized reproduction, distribution, or commercial use is prohibited.

12. Governing Law & Binding Arbitration

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms or use of the platform shall be resolved exclusively through final and binding arbitration conducted in the State of Texas.

You agree that:

• Arbitration will occur on an individual basis only.
• Class actions and collective proceedings are not permitted.
• The arbitrator has exclusive authority to determine enforceability of this provision.

Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Notwithstanding the above, TalkHub™ reserves the right to seek injunctive relief in court to protect intellectual property, confidentiality, or platform integrity.

13. Modification of Terms

TalkHub™ may update these Terms at any time.

Continued use of the platform constitutes acceptance of revised Terms.
